Felony Degrees in Texas

The Texas legal system recognizes five different levels of felony charges and convictions:

  • Second-Degree Felony: Punishable between two to 20 years in prison, $10,000 fine. Includes aggravated assault, sexual assault, online solicitation of a minor under 14 years old, human trafficking, theft valued between $100,000 and $200,000.
  • First-Degree Felony: Punishable between five to 99 years in prison, $10,000 fine. Includes attempted murder, murder solicitation, kidnapping, arson of an inhabited structure, human trafficking of children under 14, theft valued over $200,000. 
  • Capital Felony: For capital murder charges, punishable by execution.
